IP & Takedown Policy
1. Our role: sellers are responsible for their assets
HyperCodeStore is a marketplace. Assets are uploaded by independent sellers, who license them to buyers and are solely responsible for them, including for any infringement of copyright, trademarks or other rights. HyperCodeStore is not the author, owner or licensor of sellers' assets. We host them and collect payment, and we act on notices as the law requires of a hosting provider.
We do not decide who owns a work. A dispute about rights is between the rights owner and the seller; only a court can settle it. We decide what happens to the listing on our site while the dispute runs, based on the evidence in the notice and any counter-notice, and we follow any court or authority order. Under our Seller Agreement we may give the seller's name and contact details to a rights owner who reasonably claims infringement, so the rights owner can pursue the seller directly.
We check every listing before it goes live for quality and technical reasons (see how we review listings). That review is not a legal clearance of intellectual property rights, and we have no general obligation to monitor listings.
2. How to report infringing or illegal content
Use the form below — no account needed — or the "Report this listing" link on any product page. Notices can be written in English or Hungarian. A complete notice contains:
- the copyrighted work or trademark you say is infringed;
- the exact URL(s) of the listing(s) on HyperCodeStore;
- a sufficiently substantiated explanation of why the content infringes or is illegal;
- your name, email address, and — for intellectual property notices — postal address and phone number;
- a statement that you believe in good faith that the use is not authorised by the rights owner, its agent or the law;
- a statement that the notice is accurate and, under penalty of perjury, that you are the rights owner or authorised to act for them;
- your physical or electronic signature (typing your full name in the form counts as an electronic signature).
Formal notices under Hungarian law. A rights owner may also send a notice under Section 13 of Act CVIII of 2001 as a private document with full probative force (for example with a qualified electronic signature or AVDH certification) to ragendom@gmail.com. We act on such notices within 12 hours of receipt.
3. Step by step if you are the rights owner (claimant)
- Send the notice with the form below (or a formal Hungarian notice, see section 2). You get an email with a reference number straight away.
- A person reviews your evidence. Nothing is removed automatically. For formal notices under Hungarian law we act within 12 hours; other notices are handled promptly.
- Our decision, by email. If your notice is complete and the infringement is apparent, we hide the listing and lock it, and tell the seller why. If not, we tell you why, and you can reply with more evidence.
- If the seller disagrees, they can send a counter-notice. We email it to you, including the seller's name, address, phone number and email, so that you can contact or sue the seller.
- Your decision: go to court or not. Within 10 working days of our email with the counter-notice:
- You go to court: file a lawsuit or ask a court for an interim measure against the seller (under Hungarian law also a payment order or a criminal complaint), and send us proof, quoting your reference, to ragendom@gmail.com. The listing then stays hidden while the court proceedings run, and we follow the court's decision.
- You don't go to court: after the 10 working days we restore the listing.
- The court decides. HyperCodeStore is not a party to your dispute with the seller. We carry out any order a court or authority gives us.
4. Step by step if you are the seller
- You are informed. If we act on a notice about your listing, you get an email and an entry in Dashboard → Legal notices within 3 working days at the latest. It says what was claimed, by whom (name or company), what we did and why.
- Your listing is hidden, not deleted. It is off sale and locked (you cannot re-publish or delete it while the case is open). Its reviews, ratings, support questions and files are kept. Past buyers keep their licences and, unless we tell you otherwise, their downloads.
- Your choice. If the claim is right, you don't need to do anything; the listing stays hidden. If you believe it is a mistake or you hold the rights, file a counter-notice from Dashboard → Legal notices. It needs:
- your explanation of why the removal was a mistake or why you hold the rights;
- your full name, email, phone number, postal address and country;
- a statement, under penalty of perjury, that you believe in good faith the material was removed by mistake or misidentification;
- your consent to the jurisdiction of the courts where the claimant can sue you (for claims under US law, the US federal district court for your address, or if you are outside the US, any judicial district in which HyperCodeStore may be found), and that you will accept service of process from the claimant;
- your signature (your typed full name).
- We forward it to the claimant, including your name and contact details, and tell you the date from which the listing can be restored.
- The claimant decides whether to go to court within 10 working days.
- If they go to court, the listing stays hidden while the proceedings run. The dispute is between you and the claimant; we follow the court's decision.
- If they don't, we restore the listing exactly as it was: same page, reviews, ratings and support questions. The strike from this case is removed.
Formal notices under Hungarian law (Act CVIII of 2001, Section 13): you can object in the same formal way within 8 days; we then restore the listing without delay, unless the rights owner starts court proceedings within 10 working days and the court orders otherwise.
Knowingly false statements in a notice or counter-notice can make the person who made them liable for the damage they cause.
Timeline at a glance
- Day 0: notice received; the claimant gets a reference number.
- Within 12 hours (formal Hungarian notices; others promptly): our decision after a person reviews the evidence.
- Within 3 working days: the seller is informed with the reasons.
- Any time while the listing is hidden: the seller can send a counter-notice (formal Hungarian objection: within 8 days).
- Counter-notice forwarded: the claimant has 10 working days to go to court.
- After that: no court action → listing restored exactly as it was; court action → listing stays hidden until the court decides.
5. Repeat infringers
Each listing taken down after a valid notice counts as a strike against the seller's account; a strike is removed if the listing is restored after a successful counter-notice. In appropriate circumstances we suspend sellers who repeatedly infringe: after a warning, first for 30 days, then 60, then 90 days, and we terminate accounts of repeat infringers. Serious or deliberate infringement can lead to immediate termination. While a seller is suspended their listings are off sale and they cannot submit new ones.
6. Misuse of the notice system
We may stop accepting notices from anyone who repeatedly sends manifestly unfounded notices: after three, the form refuses notices from that address for twelve months. Anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for the damage caused.
7. Buyers
If a listing you bought is removed for intellectual property or legal reasons, your downloads may be blocked and you may be asked to delete your copies. Contact Support about a refund; we handle it under our Refund Policy. Your statutory consumer rights are not affected.
